Terms of Use (Effective Date: May 21, 2025)
By creating an account, logging in, or otherwise using any website, mobile application, or service that links to these Terms of Service (collectively, “Services”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
Changes to the Terms or Services
We may update these Terms or the Services at any time. Material changes will be announced by posting the revised Terms and updating the “Effective Date” above. Continued use after changes become effective constitutes acceptance.
Eligibility
You must (i) be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) and (ii) have the legal power to form a binding contract. If you access the Services on behalf of a company or other entity, you confirm you have authority to bind that entity.
Your Account & Security
- Registration. You agree to provide accurate information and keep it up to date.
- Google Sign-In. If you register through Google, you authorize us to access your Google account data as described in the Privacy Policy.
- Security. You are responsible for all activity that occurs under your credentials. Notify us immediately at support@read.haus if you suspect unauthorized access.
User Content
- Definition: “User Content” encompasses all text, images, reviews, ratings, lists, comments, or other materials you submit or post.
- Ownership: You retain all rights to your User Content.
- License: You grant read.haus a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute your User Content solely to operate, enhance, and promote the Services.
- Responsibilities: Only post content you own or have rights to share and that complies with applicable laws and these Terms.
- Feedback: Feedback provided is voluntary, and we may use it without obligation or compensation.
Prohibited Conduct
You may not:
- Violate laws, intellectual property rights, or third-party rights.
- Upload harmful code, attempt unauthorized access, or disrupt the Services.
- Harass, defame, impersonate, or abuse other users.
- Collect personal data from users without explicit consent.
- Employ automated systems (scrapers, bots) without explicit written permission.
Intellectual Property Rights
The Services, including all original software, code, content (excluding User Content), and trademarks, are owned by read.haus or its licensors and are protected by applicable laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the Services according to these Terms.
Third-Party Services & Google API Data
The Services may integrate third-party services (e.g., Google APIs). Your use of these is subject to their respective terms. Our use of Google API data adheres to the Google API Services User Data Policy, including Limited Use requirements, as detailed in our Privacy Policy.
Termination & Suspension
We reserve the right to suspend or terminate your access and remove your User Content if you materially breach these Terms or if required by law. You may terminate your account at any time by deleting it. Certain provisions (e.g., licenses, disclaimers, liability limitations) survive termination.
Disclaimers
HE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” READ.HAUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, READ.HAUS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, REGARDLESS OF THE CLAIM OR THEORY.
Indemnification
You agree to defend, indemnify, and hold harmless read.haus, its affiliates, directors, officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or violation of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by Massachusetts law, excluding its conflict-of-law rules. Any disputes will be resolved exclusively in state or federal courts located in Boston, Massachusetts, and you consent to the personal jurisdiction of those courts.
International Use
Access from outside the United States is at your own risk. You are responsible for compliance with applicable local laws.
Miscellaneous
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the complete agreement between you and read.haus.
- Severability: If any provision is found unenforceable, the remainder remains effective.
- No Waiver: Our failure to enforce any provision does not waive our right to do so later.
- Assignment: You may not assign these Terms. We may assign our rights under these Terms in connection with mergers, acquisitions, or asset transfers.
